Terms of Service
These Terms of Service govern the use of the SwissDACH CRM system.
§ 1 Scope of Application
These Terms of Service apply to all contracts between SwissDACH CRM and its customers regarding the use of CRM software and related services.
§ 2 Contracting Party

§ 3 Subject of Contract
The subject of the contract is the provision of cloud-based CRM software including:
- Customer management and contact history
- Invoice and quote creation
- Task and appointment management
- Reporting and dashboards
- AI-powered features
- Technical support
§ 4 Contract Formation
The contract is formed through registration and confirmation of the Terms of Service. By first use, the customer fully accepts these terms.
§ 5 Prices and Payment Terms
- All prices are in Swiss Francs (CHF) including VAT
- Billing is done monthly in advance
- Payment term: 30 days net
- Late payment fees of CHF 30.- apply
- Default interest rate: 5% p.a.
§ 6 Term and Termination
Contract term:
- Minimum term: 12 months
- Automatic extension by 12 months each
- Notice period: 3 months to contract end
- Extraordinary termination for cause remains reserved
§ 7 Availability and Service Level
We strive for high system availability. Support is provided within available capacity.
- Planned maintenance: Announced when possible in advance
- Support hours: As available, preferably by email
- Support scope: Best-effort basis as individual business
§ 8 Customer Obligations
The customer undertakes to:
- Keep access data confidential and secure
- Use the system only for lawful purposes
- Not upload or transmit harmful content
- Perform regular data backups
- Report security incidents immediately
§ 9 Data Protection and Security
Protection of your data has highest priority:
- Processing according to Swiss Data Protection Act (DSG) and GDPR
- Data stored exclusively in Switzerland
- SSL/TLS encryption for all data transmissions
- Regular security audits and penetration tests
§ 10 Warranty
We warrant that the software functions essentially according to the service description. Minor deviations do not justify warranty claims.
§ 11 Liability
Limitation of liability:
- Liability for intent and gross negligence: Unlimited
- Liability for slight negligence: Limited to annual fee
- Excluded: Indirect damages, lost profits, data loss
- Customer is responsible for regular data backups
§ 12 Copyright and Licenses
The software and all content are protected by copyright:
- Usage rights limited to contractually agreed use
- Reverse engineering, decompilation or modification prohibited
- Transfer to third parties only with written permission
§ 13 Force Majeure
In case of force majeure (natural disasters, cyber attacks, official orders, etc.), both parties are released from performance obligation.
§ 14 Changes to Terms
Changes to these Terms will be communicated to the customer at least 30 days before taking effect. If the customer does not object within 14 days, the changes are deemed approved.
§ 15 Severability Clause
Should individual provisions be invalid, the validity of the remaining provisions remains unaffected. Invalid provisions will be replaced by valid ones that come closest to the economic purpose.
§ 16 Applicable Law and Jurisdiction
Applicable law: Swiss law excluding UN Sales Law
Jurisdiction: Exclusive jurisdiction is Frauenfeld, Switzerland
